Probate

We handle Probate proceedings in all Texas State Courts with Probate jurisdiction.  Probate is the legal process of proving the validity of a will; however, we also use the term generally to refer to administering the estate of the decedent.  The “estate” may range in value and complexity from millions of dollars to one bank account.  There are numerous assets that might otherwise be considered non-probate assets, but due to circumstances, have become subject to probate.  

There are various probate procedures in Texas, including probating a will with independent administration, probating a will with dependent administration, muniment of title, small estate affidavits, and heirship proceedings.  Whether the decedent has a will, in which case the proceeding is an “Execution”, or died without a will, in which case the proceeding is “Administration”, we have experience assisting clients in filing all necessary Applications, Inventories, Claims proceedings, Motions, Accountings and other materials necessary to properly settle an estate.  

Attorney Wyatt is also Certified to appear in all Guardianship proceedings and to serve as Guardian if necessary.  

We represent both estate representatives, Executors or Administrators, as well as Applicants for Guardianship.  We also represent persons interested in these proceedings to advise, appear, and protect the rights of individuals interested in these matters.

In those rare situations in which an Elder Law case implementation is interrupted, or an Elder Law Client is the recipient of legacy or a gift that results in a need for Probate, we handle those Probate cases as well.
